Commerce and Insurance, Dept. of - As enacted, requires a chancery court that has found that a person engaged in or is about to engage in an act or practice constituting a violation of the Tennessee Securities Act of 1980 to appoint the commissioner as the receiver or conservator for the defendant upon request by the commissioner; makes other changes related to matters regulated by the department. - Amends TCA Title 48, Chapter 1, Part 1 and Title 49, Chapter 4, Part 1.

Monterey - Subject to local approval, deletes obsolete provisions authorizing the mayor to serve as the ex officio recorder for the town of Monterey; establishes the position of Town Administrator and prescribes the Administrator's powers, duties, and functions. - Amends Chapter 492 of the Acts of 1901; as amended.

Hospitals and Health Care Facilities - As enacted, lowers the age of an inpatient from 65 to 50 or older when a hospital, each year from October 1 through March 1, must offer immunization against influenza disease prior to discharge; requires a hospital to offer immunization against pneumococcal disease to an inpatient aged 50 or older prior to discharge. - Amends TCA Title 68.

Local Education Agencies - As enacted, requires an LEA that operates a public high school that meets certain criteria to permit certain high school students who are enrolled in private schools to participate in interscholastic athletics at the public high school. - Amends TCA Title 49.

Abortion - As enacted, revises present law that authorizes the attorney general to bring an action to enforce compliance with the Tennessee Abortion-Inducing Drug Risk Protocol Act or intervene as a matter of right in a case in which the constitutionality of such act is challenged; makes related changes. - Amends TCA Title 4, Chapter 18; Title 29, Chapter 39 and Title 63, Chapter 6, Part 11.

Education - As enacted, expands the prescribed forms of epinephrine that an LEA or nonpublic school is authorized to administer when a student is believed to be experiencing a life-threatening allergic or anaphylactic reaction to any prescribed form of epinephrine, not just epinephrine auto-injectors. - Amends TCA Title 49 and Title 68, Chapter 140, Part 5.

Health Care - As enacted, revises law relative to the operation of acute care hospitals. - Amends TCA Title 4; Title 33; Title 68; Title 71 and Chapter 985 of the Public Acts of 2024.

Taxes - As enacted, provides that an application for an exemption from property taxation for property owned by a religious, charitable, scientific, or nonprofit educational organization that is filed within 180 days after the exempt use of the property began will be effective as of the date the exempt use began, if the application is made after May 20th of the year for which the exemption is sought, but prior to the end of the year; makes other related changes. - Amends TCA Title 67.

Obion County - Subject to local approval, clarifies that the county highway superintendent of the county highway department be appointed by the county commission pursuant to state law. - Amends the private acts of Obion County.

Alcoholic Beverages - As introduced, requires the alcoholic beverage commission to produce an annual report listing the persons convicted for offenses related to alcohol vaporizing devices; requires the report to be filed with the chair of the state and local government committee of the senate and the chair of the committee having jurisdiction over consumption of alcoholic beverages on premises in the house of representatives no later than December 1, 2026, and each December 1 thereafter. - Amends TCA Title 57.

Bail, Bail Bonds - As enacted, allows the court to temporarily revoke a defendant's bond and order the defendant held without bail for no more than 10 days pending a bail revocation hearing if the defendant violates a condition of release, is charged with an offense committed during the defendant's release, or engages in conduct that results in the obstruction of the orderly and expeditious progress of the trial. - Amends TCA Title 40, Chapter 11.

Health Care - As introduced, removes acute care hospitals from the requirement of obtaining a certificate of need beginning July 1, 2028. - Amends TCA Title 4; Title 33; Title 68; Title 71 and Chapter 985 of the Public Acts of 2024.

Unemployment Compensation - As introduced, removes a requirement that work be deemed suitable for a claimant if certain criteria are met and a claimant's gross weekly wages equal or exceed certain threshold percentages of the claimant's weekly wage for insured work for the quarter of the base period when the claimant's wages were greatest. - Amends TCA Section 50-7-303.

Criminal Procedure - As enacted, prohibits a defendant charged with certain offenses from being released on the defendant's personal recognizance or upon execution of an unsecured bond. - Amends TCA Title 40.

Sentencing - As introduced, requires a sentencing court to order the sentences for two or more offenses involving more than one minor victim to run consecutively unless the court finds by a preponderance of the evidence that the facts of the case do not warrant the imposition of consecutive sentences and the imposition of consecutive sentences would not be in the best interest of justice. - Amends TCA Title 40.

Taxes, Sales - As introduced, extends the deadline by which a county that borders at least three distressed rural counties must apply to be eligible to retain the sales and use tax generated from a commercial development district from December 31, 2026, to December 31, 2040; extends the deadline for the commissioner of finance and administration to approve a commercial development district from June 30, 2031, to June 30, 2041. - Amends TCA Title 67, Chapter 6.

Courts - As enacted, enacts the "Violent Criminal Court Act." - Amends TCA Title 8; Title 10; Title 16; Title 37; Title 38; Title 39; Title 40; Title 41 and Title 55.

Taxes, Sales - As introduced, authorizes an entity designated to operate a stadium designed to host games of an intercollegiate football team that competes in the NCAA Division I Football Championship Subdivision (FCS) to receive a special allocation of state and local sales tax revenue derived from the sale of admission to events occurring within the stadium and from all sales of food, drinks, merchandise, and parking sold on the premises of the stadium to fund capital and operation expenses for the stadium. - Amends TCA Title 67, Chapter 6.

Contracts - As enacted, requires a court to apply rebuttable presumptions when determining the reasonableness in time of a restrictive covenant sought to be enforced after the termination of an employment or business relationship; makes related changes. - Amends TCA Title 50; Title 63 and Title 68.
